Pre-election guidance: clarification for NHS foundation trusts on governor elections

Several NHS foundation trusts have asked for clarification on governor elections during purdah. 

The conduct of elections is for NHS foundation trusts to address.  Trusts should consider how they run their elections in accordance with the requirements of their constitution and in conjunction with the returning officer appointed under the election rules.

We'd expect trusts to consider whether it is possible and appropriate to adjust the election timetable to ensure that due consideration is given to the principles established through Cabinet Office guidance.  This should include consideration of the likely costs of any postponement.

As a general rule we’d advise that, where possible, trusts do not hold governor elections during the purdah period unless the delay would lead to a breach of statutory requirements, a trust’s constitution or the election rules.  This is to help you stay within the guidelines issued by the Cabinet Office that public bodies should not undertake activity which might enflame local political campaigns or which might distract public attention from the general election.

Translation and interpretation services

We've been made aware of some possible concerns about the quality of translation and interpretation services being provided to trusts. We'd like to remind you to ensure your providers of these types of services are meeting the service level agreements in place for providing these types of services.

Company secretaries should be aware that we've recently emailed all chief executives and finance directors with the details on how to self-certify whether or not you have complied with the relevant provisions in the NHS provider licence.
