Update to guidance on IR35, agency and locum rules

Following feedback from nurses about our latest agency rules on substantive staff, until further notice we're pausing our instruction that you should ensure staff employed through an agency are not substantively employed elsewhere in the NHS.

This new rule will not start from 1 April 2017 and your normal processes can remain in place.

IR35 rules

Due to HMRC regulations, the IR35 rules remain in place and applied from 1 April 2017.

Changes to support arrangements for NHS Safety Thermometer

As of 1 April, the NHS Safety Thermometer is managed on our behalf by NHS South, Central and West Commissioning Support Unit (SCW). SCW has taken over responsibilities for supporting the ‘classic’ data set previously managed by NHS Digital

Healthcare Safety Investigation Branch (HSIB) begins operating

The HSIB will investigate up to 30 safety incidents every year to provide safety recommendations and share learnings. 

From the Department of Health (DH): General ophthalmic service fees and voucher values

From 1 April there is no change to the current hospital eye service maximum charge and optical voucher values. Both remain at the same level as 2016/17.

From DH: independent reconfiguration panel (IRP) vacancies – three managerial members

The IRP provides independent expert advice to the Secretary of State on disputed proposals for changes to clinical services in the NHS in England.

Members will assist in providing formal advice to the Secretary of State and advice and support to the NHS, local authorities and other interested parties, and will develop and disseminate good practice.

From DH: NHS Counter Fraud Authority (NHSCFA)

This new, independent organisation is dedicated to tackling fraud, bribery and corruption within the health service in England.

The NHSCFA is starting in shadow form from 1 April 2017 and will be established as an independent special health authority from July 2017. It replaces NHS Protect.
